AMD, Intel Wage Evidence War Before Antitrust Trial
In its container.Intel's request, if granted, would result in sanctions against AMD for improperly retaining reveal and for secretly restoring some of that evidence, and require AMD to provide yet more evidence from certain executives, whose names were concealed in the celebrated filing. AMD would also be forced to summarize the "relevant facts" of the retention issue.
AMD, meanwhile, is asking for the jury in the case to be instructed, in what AMD called an "adverse surmise instruction," of Intel's alleged destruction of significant documents.
"That instruction provides that the jury be told that (1) Intel everlastingly destroyed hundreds of thousands of relevant documents and (2) the jury may guess that the documents Intel destroyed and failed to deliver would have been favorable to AMD's claims that Intel violated Allot 2 of the Sherman Act," AMD's own brief requests. "In addition to, but not in lieu of an adverse conclusion instruction, AMD requests that the Court permit affidavit of Intel's document destruction to be presented to the jury. Lastly, AMD asks the Court to order Intel to pay the conservative attorneys' fees and costs associated with investigating and prosecuting this motility."
